Terms of Service

Welcome to Vantage Technologies AS ("Vantage," "we," "our," or "us"). By using the Vantage app, you ("user" or "you") agree to these Terms of Service. Please read carefully, as they constitute a legally binding agreement.

By creating an account or using our app, you confirm that you have read, understood, and agree to these Terms of Service ("Terms") and our Privacy Policy. If you disagree with any part of the Terms, please discontinue use.

To use the Vantage app, you must be at least 16 years old. Users aged 13–15 may only use the app with verifiable parental or guardian consent. By allowing a minor between the ages of 13 and 15 to use the app, the parent or guardian consents to these Terms on their behalf and assumes responsibility for the minor's account, data usage, and compliance with these Terms.

• Account Setup: You agree to provide accurate, current, and complete information when creating an account.
• Security: You are responsible for safeguarding your password and any other credentials. You agree to notify Vantage immediately of any unauthorized account use.
• User Conduct: You agree to use Vantage responsibly and only for lawful purposes. Misuse of features or violation of these Terms may lead to account termination.

Users may not attempt to access the service through automated means, scrape data, reverse engineer the application, or use the service in a manner that could harm the platform or other users.

• Data Usage: By using Vantage, you consent to the collection and use of performance and GPS data for analysis, feedback, and app improvement.
• Privacy Policy: Please refer to our Privacy Policy for details on data collection, processing, and security. Your data is treated with strict confidentiality and in compliance with data protection laws.
• Account Deletion: Users may request deletion of their account at any time through the app. Upon deletion, Vantage Technologies AS will remove personal account information in accordance with applicable data protection laws.

• Data Ownership: You retain ownership of any sailing data and performance metrics you generate. However, by uploading data, you grant Vantage a license to analyze, display, store, and anonymize data to enhance the user experience and app functionality.
• Prohibited Content: You agree not to upload content that is inappropriate, offensive, or violates any laws.

• Vantage App Content: All features, designs, data analytics tools, and branding are owned by Vantage Technologies AS. Users may not copy, modify, distribute, or reverse-engineer these resources without written permission.
• User Rights: You are granted a limited, non-exclusive right to access your data and insights within the app but may not extract or reproduce analytics for commercial gain.
• Users may not reproduce, distribute, or commercially exploit Vantage analytics tools or outputs without written permission.

The Vantage service is provided on an "as is" and "as available" basis. Vantage Technologies AS makes no warranties regarding availability, reliability, or uninterrupted access to the service.

• Data Accuracy: While Vantage strives to provide accurate insights, no guarantees are made regarding the precision of data analysis.
• User Liability Waiver: Vantage is not responsible for any accidents, damages, or injuries occurring while you use the app during sailing or other activities. Use at your own risk.

The Vantage service may integrate with or rely on third-party services. Vantage Technologies AS is not responsible for the availability or performance of such third-party services.

Vantage provides tools for users to connect and share performance data, but does not supervise or control interactions between users. Users are solely responsible for how they share information with others.

If you purchase a subscription through the Apple App Store or Google Play Store, payment will be processed by the respective platform provider. Subscriptions automatically renew unless canceled.

You may manage or cancel your subscription at any time through your Apple App Store or Google Play Store account settings.

Refunds are issued solely at the discretion of Apple or Google and are subject to their respective refund policies. Vantage Technologies AS does not have the ability to issue refunds for purchases made through these platforms. Vantage Technologies AS does not process subscription payments directly and does not control the billing or refund processes for purchases made through these platforms.

Vantage reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activities, or misuse app features.

Vantage Technologies AS may modify, suspend, or discontinue features of the service at any time.

Vantage may modify these Terms from time to time. You will be notified of significant changes through the app or by email. Continued use of the app indicates acceptance of revised Terms.

These Terms are governed by the laws of Norway. Any disputes arising from these Terms or app use will be handled by the courts of Norway.
